Your brother’s workers’ compensation income won’t count in determining if you can file return as head of household. You can file as head of household if all these apply:

  • When filing taxes, you claimed your disabled brother as a dependent, or he meets the requirements to be your qualifying child due to his disability.
  • He lived with you for more than half the year.
  • You provided more than half the cost of keeping up the home where you both live.
